This has been worked on for about 4~ some years from what I'm told. Sad, really. It's not so much them taking action. It's taking action at the last minute. In Square-Enix's defense it was probably a coincidence. Would they be that cruel on purpose? Well, they have the right but still... :/

Encouraged game modification is one of the things I love about the western game industry. If Square-Enix was wise, they would have taken a lesson from Counter-Strike.

Yeah. AFAIK things like the MOTHER 3 and Persona 2 translations only boosted the fan base. No one lost any money.

and in the case of Counter-Strike, Valve made fucking millions by hiring the people who made the original Half-Life mod

Dick move.
Big question here is, are IPS patches illegal or not?

The patch itself? No. The ROM required to USE it? Yeah. It is of question though since there was some reverse engineering of the code done and that is covered by copyright law.

I'll have to double check but I believe it modded CT to the point that it was JUST Crimson Echoes and not the full game. Most the people, if not ALL, are ones who have already played Chrono Trigger; most of those are those who already own a copy at some point. I fail to see how modding the game to be completely new content encourages people to pirate the original (barring those who have never played CT anyway).
If nothing else, it could've been released as a WiiWare only title. Not really in the same realm of Counterstrike (and Day of Defeat) but there exists the possibility of S-E hiring them and selling it.
I only hope this isn't just some "IT'S OURS BACK OFF" move on S-E and that they're working on something related to the Chrono franchise ... that isn't a Cross remake/port.
Edit: Just in case people weren't aware, the C&D came shortly after CE entered Beta and was slated to release at the end of the month.
I hope this doesn't become "the thing" to do and shuts down translation projects everywhere. So many good games don't come here and either learning Japanese (or playing with a walkthrough) or a translation patch is the only option. It's the entire reason I own an R4 and contemplate modding my PS2 >>.
Now what about doujin based off their licenses that are being sold for a profit?
You need the original ROM to apply the patch to, and then you need either an emulator to play the game, or some sort of flashcart. Thus any unofficial romhack encourages some combination of the unholy trinity: ROMs, emulation, and flashcarts. (Compare this to doujinshi, fanmade games and fanart, which require none of the above.)
If S/E were to rest on their laurels and watch quietly as the romhack receives attention and praise, they're indirectly allowing or encouraging all of those things. That doesn't seem to be something that they wish to allow.
I'll agree that this is supremely frustrating, though, and frankly I think they could have spent less time and money sending C+D letters, and more on making the DS port less mediocre.
