Surely this is analogous to shouting FIRE in a crowded theater, though. The argument must rest on whether it is damaging and profane to society; ie, where the welfare of the masses is enough to outweigh personal freedom.

Freedom of speech is neither unlimited nor unfettered and never has been.

It's not a subject on restriction of speech and all that.

People can make the stuff, whatever, that's their decision, but it's the government's responsibility to make sure that it doesn't show up on their own registers as something that they have taxed and approved of and gained money off of and thereby give consent that they approve of the product.
